These terms and conditions (“Terms and Conditions”) apply to the Site, Kulskaf Empire, and all of its divisions, subsidiaries, and affiliate-operated Internet sites which reference these Terms and Conditions.
“Kulskaf Empire” means Kulskaf Empire (Reg No: 202503251454), a company incorporated in Malaysia and having its registered address at 45, Jalan Puteri 5E/7, Bandar Puteri, Bangi, 43000 Kajang, Selangor, Malaysia.

By accessing the Site, you confirm your understanding and acceptance of these Terms and Conditions. If you do not agree, you shall not use this website. The Site reserves the right to modify or update these Terms and Conditions at any time without prior notice. Changes take effect immediately once posted on the Site. Continued use of the Site confirms your acceptance of all updated Terms and Conditions.

USER SUBMISSIONS

Any content you submit to the Site or on our social media platforms—including questions, comments, reviews, or suggestions (“Submissions”)—will become the sole property of Kulskaf Empire and will not be returned to you.

By posting reviews or comments, you grant us the right to use the name you submit in connection with such content. You agree not to use a false email, impersonate another person, or mislead Kulskaf Empire or third parties regarding the origin of any Submissions. Kulskaf Empire reserves the right (but is not obligated) to edit or remove any Submissions.

ORDER ACCEPTANCE AND PRICING

Kulskaf Empire reserves the right to refuse or cancel any order at any time for any reason. Additional verification such as address or phone number may be required before order acceptance.

We strive to provide accurate pricing information. However, errors may occur, including incorrect product prices shown on the Site. In such cases, we reserve the right to refuse or cancel orders, regardless of whether the order has been processed or payment has been made. We may contact you for further instructions or cancel the order and notify you accordingly.

APPLICABLE LAW AND JURISDICTION

These Terms and Conditions shall be governed by the laws of Malaysia. Subject to the Arbitration section below, both parties agree to submit to the jurisdiction of the courts of Malaysia.

ARBITRATION

Any dispute arising out of these Terms and Conditions shall be settled by private and confidential binding arbitration in Malaysia. The arbitration shall be conducted in English, governed by Malaysian law, and overseen by a legally trained and independent arbitrator with relevant expertise.
Kulskaf Empire reserves the right to seek injunctive or equitable relief in court to protect intellectual property rights and confidential information.

TERMS OF USE

1. Interpretation

1.1
“Buyer” – the person who accepts a quotation from Kulskaf Empire or enters into a contract for the supply of Goods.
“Conditions” – the terms and conditions stated in this document.
“Contract” – the agreement for purchase/sale of Goods between Buyer and Kulskaf Empire.
“Goods” – products supplied by Kulskaf Empire as stated in the Contract.
“Writing” – includes email, electronic communication, or any similar method.
“Kulskaf Empire” – Kulskaf Empire (Reg No: 202503251454), registered at 45, Jalan Puteri 5E/7, Bandar Puteri, Bangi, Selangor.

References to statutes include amendments or re-enactments.

Headings are for convenience only and do not affect interpretation.

2. Orders and Specifications

2.1
A Contract is only concluded once Kulskaf Empire issues a dispatch confirmation. The company may refuse or cancel orders at any time before dispatch without providing reasons. Verification information may be required before dispatch.

2.2
A confirmed Contract cannot be modified or canceled unless agreed in writing. The Buyer shall indemnify Kulskaf Empire for all losses or expenses due to cancellations or modifications.

3. Price

The price of Goods is based on the price displayed on the Site at the time of purchase. Prices exclude delivery charges unless stated otherwise.

4. Terms of Payment

Payments must follow the payment methods available on the Site. All payment terms displayed on the Site form part of this Contract.

5. Delivery / Performance

5.1
Delivery is made to the address provided by the Buyer.

5.2
Kulskaf Empire may subcontract delivery obligations at any time without notice.

5.3
Delivery dates are estimates. Kulskaf Empire shall not be liable for delays.

5.4
If Kulskaf Empire fails to deliver within a reasonable period, the Buyer may issue a written request for performance within at least 14 days. If still undelivered, the Buyer may terminate the Contract for the affected Goods.

5.5
If Buyer refuses to receive Goods without valid reason:

  • Goods may be resold, and Buyer will be charged for losses; or
  • Contract may be terminated with damages claimed.

6. Force Majeure

Kulskaf Empire shall not be liable for delays caused by factors beyond its control, including but not limited to:

  • Natural disasters
  • War or civil unrest
  • Government regulations
  • Import/export restrictions
  • Labour disputes
  • Power failure
  • Machinery breakdown

Kulskaf Empire may suspend deliveries or terminate the Contract if such events occur.

7. Notices

Notices must be submitted in writing to the respective registered addresses.

8. Liability

8.1
Kulskaf Empire is liable for injury or death caused by its negligence.

8.2
Kulskaf Empire is not liable for issues outside its control.

8.3
No liability for loss of profit, revenue, goodwill, or any indirect damages.

8.4
Claims must be made within 2 months of awareness and no later than 2 months after warranty expiry.

9. Termination

Kulskaf Empire may suspend deliveries or terminate the Contract if:

  • Buyer breaches obligations
  • Buyer faces insolvency, winding-up, receivership, or similar events
  • Buyer applies for protection from creditors

10. General

10.1
Incoterms apply unless conflicting with these Conditions.

10.2
No waiver of breach applies to subsequent breaches.

10.3
If any provision is invalid, the remaining provisions continue in effect.

10.4
Third parties have no rights under this Contract unless expressly agreed.

10.5
Contract is governed by Malaysian law.

10.6
Kulskaf Empire reserves the right to amend these Terms & Conditions at any time.
